These terms set out the rights and obligations for the use the website and should be read in conjuction with our Privacy Policy.

 

1. About this Agreement

These Terms of Use are a legal document which set out your (“you”, “member”, “users” or “the user”) rights and obligations and those of the provider. Access to and use of www.stourbridgescouts.org (“the website” or “this site”) both within the UK and internationally is provided by Stourbridge District Scout Council (hereafter refered to as “www.stourbridgescouts.org”, “the Council”, “we”, “our” or “us”). These terms apply to your use of the website and shall take effect immediately from your first use of the website and thereafter. Please note, in order to use the website you must agree to be bound by all the terms provided (Please note, if you do not agree to be bound all the terms herein, we do not permit you to access, use and/or contribute to the website). We may change these terms from time to time and so you should check these on a regular basis. Your continued use of the website will be deemed acceptance of any updated or amended terms. If you do not agree to the changes, you should cease using the website. If there is any conflict between these terms and specific local terms appearing elsewhere on the website then the latter shall prevail in relation to the matter to which it specifically relates.

The material and information contained on this web site are for general information purposes only. The majority of content posted on this website is created by Scouting volunteers and members of the public and as such the views expressed are theirs unless specifically stated otherwise. You should not rely upon the material or information on the website as a basis for making any business, legal or any other decisions. Whilst we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied about the completeness, accuracy, reliability, suitability or availability with respect to the web site or the information, products, services or related graphics contained on the web site for any purpose. Any reliance you place on such material is therefore strictly at your own risk.

Any links to third party websites from this website do not amount to any endorsement of that site by Stourbridge District Scout Council and any use of any third party website by you is at your own risk. Inward links to the website must be appropriate and relevant in the context of The Scout Association and Stourbridge District Scout Council and must not give the impression that The Scout Association and Stourbridge District Scout Council are in any way associated with or have approved such other site.

Stourbridge District Scout Council does not guarantee the timeliness, completeness or performance of the website or any of the content and accepts no liability for any disruption or non-availability of the website, losses or damages. While we try to ensure that all content is correct at the time of publication, no responsibility is accepted by or on behalf of Stourbridge District Scout Council for any errors, omissions or inaccurate content on the website. We reserve the right to withdraw or modify one or more aspects of the website where we have legal or technical reasons to do so.

Accordingly, to the extent that the law permits, you release The Scout Association, Stourbridget District Scout Council, District Officers and the www.stourbridgescouts.org website creators, volunteers and employees from all liability arising out of or in connection with www.stourbridgescouts.org and the material included.

 

3. Personal Information and Data Protection

Any personal information provided by you in the process of interacting with this website will be collected, stored and used in accordance with our Privacy Policy. The Privacy Policy forms part of this Agreement and must be construed in conjunction with this Agreement. We will take every precaution to avoid personal data being used for improper purposes.

 

4. Use of the website

You agree to use the website only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit anyone else’s use and enjoyment of the website, for example, by disruptive behaviour, causing distress to another person or transmitting obscene, offensive, defamatory or illegal content. You may not post spam or advertising or promotional material of a commercial nature. We reserve the right to block or remove any comments deemed to be in breach of this condition.

www.stourbridgescouts.org, Stourbridge District Scout Council or its affiliates may in the future offer new services through the website from time to time. Your use of these services may be subject to additional terms and conditions or rules of use. These terms or rules will be notified to you in an appropriate manner (as determined by Stourbridge District Scout Council in its reasonable discretion). Any failure by you to comply with a material provision of the terms or rules governing those services will constitute a breach of this Agreement.

 

5. Information posted on the site by members

The user should be aware that we do not pre-screen or monitor all of the material contributed by members. However we do randomly monitor the website to support the Child Protection Policy of The Scout Association. www.stourbridgescouts.org has no control over or responsibility for the accuracy of any material available on the site, whether provided by members or others.

 

6. Viruses

Every effort is made to ensure downloadable and online content is free from viruses. Stourbridge District Scout Council cannot accept any liability for damages resulting from virus infection.

 

7. Membership of the website

User accounts to the website will only be provided to adult “members” of the Scout Association involved in Scouting in the Stourbridge District.

 

7.1 Withdrawal of material and termination of membership

Each member acknowledges that we are entitled to withdraw any material on the website which appears whether based on information received from members or others, or our own determination to be capable of breaching any part of this Agreement, or to bring the website, Stourbridge District Scout Council or The Scout Association into disrepute. Each user acknowledges that we do not monitor all material which appears on the site. The User is held responsible for ensuring that no material used on this service will:

  • Cause offence or be of a threatening or obscene nature.
  • Be defamatory or illegal material of any nature. This includes text, graphics, video, programs or audio;
  • Violate, plagiarise, or infringe the intellectual rights of Stourbridge District Scouts Council, The Scout Association or third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.
  • Breach the laws of this Country or the Country where message is destined.

We reserve the right, if a member appears to us to be in breach of any provision of this Agreement: (a) to suspend or terminate any member’s access to www.stourbridgescouts.org, or parts of it, (b) to edit, or require the member to edit material posted on www.stourbridgescouts.org. Any person whose access has been suspended or terminated must not re-register for, or re-access, www.stourbridgescouts.org without our prior consent. Each member is responsible for everything which is done on or through www.stourbridgescouts.org while their membership account is logged on to www.stourbridgescouts.org, or through their email address(es).

If you see anything on the website that you think would cause offence, appears inappropriate or you feels infringes this Agreement, then please inform us by using the contact form.

 

8. Intellectual Property

All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on the website and all content (including all content submitted by members) located on the website shall remain vested in Stourbridge District Scouts Council, The Scout Association or its licensors (which includes other users).

You may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use website content in any way except for your own personal, non-commercial use or non-commercial use directly related to Scouting within the UK. You also agree not to adapt, alter or create a derivative work from any website content except for your own personal use. Any other use of the website content requires the prior written permission of Stourbridge District Scout Council.

The names, images and logos identifying The Scout Association, Stourbridge District Scout Council or third parties and their products and services are subject to copyright, design rights and trade marks of The Scout Association and/or third parties. Nothing contained in these terms shall be construed as conferring any licence or right to use any trade mark, design right or copyright of The Scout Association or any other third party.

 

8.1 Contributions to the website

By sharing any contribution (including any text, photographs, graphics, video or audio) on the website you agree to grant to the Stourbridge District Scout Council and The Scout Association, free of charge, permission to use the material in any way it wants (including modifying and adapting it for operational and editorial reasons) for use in any media worldwide sanction by Stourbridge District Scout Council (including on The Scout Association’s website accessed by international users). In certain circumstance The Scout Association may also share your contribution with trusted third parties. Copyright in your contribution will remain with you and this permission is not exclusive, so you can continue to use the material in any way including allowing others to use it. In order that Stourbridge District Scout Council and The Scout Association can use your contribution, you confirm that your contribution is your own original work, is not defamatory and does not infringe any UK laws, that you have the right to give us permission to use it for the purposes specified above, and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent/carer if they are under 16.

 

9. Indirect or Consequential Loss and Indemnity

www.stourbridgescouts.org, Stourbridge District Scout Council or The Scout Association will not be liable to the User or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise). www.stourbridgescouts.org, Stourbridge District Scout Council or The Scout Association will also not be liable for any failure to perform of its obligations under this Agreement caused by matters beyond its reasonable control. The User will hold harmless any claims that arise against www.stourbridgescouts.org, Stourbridge District Scout Council or The Scout Association from a breach of this agreement by themselves or any third party he or she authorises to use the service.

 

10. Assignment

We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement. You may not without the written consent of www.guildfordwestscouts.org.uk assign or dispose of this Agreement.

 

11. Changes to this Agreement

www.stourbridgescouts.org reserves the right to change this Agreement from time to time, and post the new version on www.stourbridgescouts.org website. The new version of these terms and conditions will take effect immediately, and will govern all www.stourbridgescouts.org services and your relationship with www.stourbridgescouts.org. If you do not wish to be governed by the new version of the Agreement you must cease to use www.stourbridgescouts.org.

 

12. Severability

In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.

 

13. Legal Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

 

14. Entire Agreement

This Agreement includes the www.stourbridgescouts.org Privacy Policy. Together they contain the whole of the Agreement between us and users and members concerning www.stourbridgescouts.org and they replace all earlier agreements and understandings with members and users, except for any fraud or fraudulent representation by either of us. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement.
